These Terms & Conditions (“Terms”) govern your use of oliviaevoo.com (the “Site”) and any purchase you make from it. The Site is operated by Olivia Gourmet, LLC, doing business as Olivia Olive Oil (“Olivia Olive Oil,” “we,” “us,” “our”), 118 East Main Street, Franklin, Tennessee 37064, United States.

Please read these Terms carefully. By placing an order or using the Site, you agree to them. If you do not agree, please do not use the Site or place an order.
1. Who we are, and what these Terms cover
Olivia Olive Oil is a specialty olive oil and balsamic vinegar shop with a single retail location in Franklin, Tennessee. We sell food and related goods online and in store.
These Terms apply to the Site, to online orders, to in-store pickup of online orders, and to gift certificates and event tickets purchased through the Site. Our Privacy Policy and our Returns & Refunds policy are part of these Terms and are incorporated by reference.
2. Changes to these Terms
We may update these Terms from time to time. The version in effect when you place an order is the version that governs that order. We will update the effective date above when we make changes, and material changes will be reflected on this page before they take effect. Your continued use of the Site after a change means you accept the updated Terms.
3. Who may order
You must be at least 18 years old, or have the involvement of a parent or guardian, to place an order. By ordering, you confirm that the information you give us is accurate and that you are authorized to use the payment method you provide.
We currently sell and ship only within the United States. We do not accept orders for delivery outside the United States.
4. Orders and order acceptance
Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation email or, if earlier, when we ship the order or make it available for pickup.
We may decline or cancel an order, in whole or in part, at any time before shipment or pickup — for example if an item is out of stock, if we cannot verify your billing or shipping information, if a price or description was posted in error, if we suspect fraud, or if the order appears to be for resale. If we cancel an order you have already paid for, we will refund you in full.
Pricing and description errors. We work hard to keep prices, descriptions, images and availability accurate, but errors happen. If an item’s correct price is higher than the price shown when you ordered, we will contact you before shipping and give you the choice to confirm the order at the correct price or cancel it for a full refund. We are not obliged to sell at an incorrect price.
Order changes and cancellation. If you need to change or cancel an order, call us at (615) 771-9595 as soon as possible. We will do our best, but we cannot change or cancel an order once it has shipped.
5. Prices, taxes and payment
All prices are shown in U.S. dollars (USD) and exclude shipping and applicable sales tax, which are calculated and displayed at checkout before you pay.
Tennessee sales tax is applied as required by law. Tennessee applies a reduced rate to qualifying food and food ingredients and the general rate to other goods, so a single order may show more than one tax line. Orders picked up in store are taxed at our Franklin store address rather than at your address, which is how Tennessee law treats an in-store sale.
Payment. We accept the credit and debit cards shown at checkout. Card payments are processed by Authorize.Net. Your full card number is transmitted directly to the payment processor; we do not store your full card number on our systems. Payment is taken when you place your order. If your payment is declined or reversed, we may cancel the order.
On your card statement, this purchase will appear as OLIVIA OLIVE OIL. If you do not recognize a charge, please call us before disputing it — we can almost always resolve it faster than your bank can.
6. Shipping and delivery
We ship within the United States only. Shipping charges are calculated and shown at checkout before you pay.
Dispatch time. We aim to dispatch orders within a few business days. If we cannot ship your order within 30 days of receiving it, we will contact you with a revised date and give you the option to accept the delay or cancel for a full refund. Delivery estimates given by us or by a carrier are estimates, not guarantees.
Risk of loss and title pass to you when the order is delivered to the address you gave us, or when you collect it in store. If your order is lost or damaged in transit, contact us — see our Returns & Refunds policy.
Address accuracy. Please check your shipping address carefully. We are not responsible for orders delivered to an incorrect address supplied by you, and re-shipping costs in that case are yours.
Weather. Olive oil can cloud or partially solidify in cold temperatures. This is a natural characteristic of real olive oil, not a defect, and it reverses at room temperature. See our Returns & Refunds policy for more.
7. In-store pickup
If you choose Local Pickup at checkout, your order will be prepared at 118 East Main Street, Franklin, Tennessee 37064. Please wait for our “ready for pickup” notification before coming in.
We will hold a paid pickup order for 30 days. If it has not been collected by then, we will try to contact you; if we cannot reach you, we may cancel the order and refund it, less any perishable items that can no longer be sold. We may ask to see the order confirmation and photo ID at collection.
8. Returns, refunds and exchanges
Our Returns & Refunds policy forms part of these Terms. In summary, and subject to that policy in full:
- Because of food quality and freshness standards, we cannot accept returns or exchanges on olive oil products.
- Other eligible products may be returned or exchanged within 14 days of confirmed delivery, in original packaging and resaleable condition.
- All returns must be authorized in advance. Call (615) 771-9595 and ask for a manager, with your order number to hand.
- Return shipping is at your expense unless the item was damaged, defective, or incorrect, or the problem was our error.
- If your order arrives damaged, defective or incorrect, contact us within 14 days. For shipping damage, keep all packaging and photograph both the box and the items — we need these for the insurance claim.
- Refunds are issued to the original payment method. Shipping charges are non-refundable except where the fault was ours.
Nothing in these Terms limits any right you have under applicable consumer protection law.
9. Gift certificates
Gift certificates purchased from us are redeemable for merchandise from Olivia Olive Oil.
- They do not expire and carry no dormancy, inactivity or service fees.
- They are not redeemable for cash except where required by law, and they cannot be reloaded.
- Treat a gift certificate like cash: we cannot replace one that is lost or stolen.
- Any unused balance stays on the certificate for future use.
10. Classes, tastings and events
Tickets to classes, tastings and events are sold for a specific date, time and location and are valid only for that event.
- Unless the event listing says otherwise, cancellations made 3 or more days before the event may be refunded or transferred to another date; cancellations inside that window, and no-shows, are non-refundable.
- If we cancel or reschedule an event, you may transfer to another date or receive a full refund.
- Tickets are transferable to another guest — just tell us the name in advance.
- We may ask guests to leave, without refund, for behavior that puts other guests or staff at risk.
11. Gift messages and content you give us
If you add a gift message or other text to an order, you are responsible for it, and you confirm you have the right to use any names or content it contains. We may decline to print any message that is unlawful, abusive, hateful, harassing, obscene, or infringes someone else’s rights. If we decline, we will contact you.
12. Food products: allergens, storage and health
Please read this section carefully — it matters more than most of this page.
- Our products are food. Some contain or are produced in facilities that also handle common allergens, including but not limited to nuts, sesame, dairy, soy, wheat and gluten. If you have a food allergy or intolerance, check the product packaging and contact us at orders@oliviaevoo.com or (615) 771-9595 before ordering. Ingredient information on the Site is provided in good faith, but the label on the product you receive is the definitive source, and suppliers may change formulations without notice.
- Store products as directed on the label. Olive oil and vinegar should be kept away from heat and direct light and used within the period indicated on the bottle. We are not responsible for products stored or handled improperly after delivery or pickup.
- Health information on this Site is general information, not medical advice. Any statements on the Site about olive oil, polyphenols, or the health properties of our products have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure or prevent any disease. Do not use anything on this Site as a substitute for advice from a qualified healthcare professional. If you have a medical condition, are pregnant, or are taking medication, talk to your doctor before making dietary changes.
- Recipes and serving suggestions published on the Site are provided for general interest. You are responsible for safe food handling, cooking temperatures, substitutions, and for checking that a recipe is suitable for anyone you serve it to.
13. Product descriptions, images and availability
We try to display our products accurately, but colors, sizes, labels and packaging may vary from the images on the Site — screens differ, and producers change labels. Vintage, harvest and origin information for oils and vinegars changes as stock rotates.
All products are offered subject to availability. We may change or discontinue any product at any time.
14. Your account
If you create an account, you are responsible for keeping your password confidential and for activity that happens under your account. Tell us promptly at info@oliviaevoo.com if you believe someone else has used your account. We may suspend or close an account that we reasonably believe is being used fraudulently or in breach of these Terms.
15. Acceptable use of the Site
You agree not to use the Site to: break the law; interfere with or disrupt the Site or its security; attempt to gain unauthorized access to any part of it; scrape, harvest or copy content in bulk, whether by automated means or otherwise; place fraudulent or automated orders; or test payment card numbers.
16. Our content
All content on the Site — text, recipes, photographs, graphics, logos and the “Olivia Olive Oil” name — is owned by us or our licensors and is protected by copyright, trademark and other laws.
You may view the Site, and print or download individual pages for your own personal, non-commercial use. You may not otherwise copy, republish, sell or commercially exploit our content without our prior written permission.
17. Links to other websites
The Site may link to sites we do not control. We are not responsible for their content, products, or privacy practices. Links are not endorsements.
18. Disclaimer of warranties
PLEASE READ THIS SECTION AND SECTION 19 CAREFULLY. THEY LIMIT OUR LIABILITY TO YOU.
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.
EXCEPT WHERE PROHIBITED BY LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY WE GIVE IN WRITING, WE DISCLAIM ALL WARRANTIES WITH RESPECT TO PRODUCTS SOLD THROUGH THE SITE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.
This does not affect the statutory rights of consumers where those rights cannot lawfully be excluded, and it does not limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be limited.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT YOU BUY FROM US WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
20. Indemnity
You agree to indemnify and hold harmless Olivia Olive Oil and its owners, employees and suppliers from claims, damages and reasonable costs arising out of your breach of these Terms, your misuse of the Site, or content you supply to us.
21. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, carrier delays or failures, supplier shortages, utility or network outages, fire, flood, labor disputes, epidemic, or acts of government.
22. Governing law and venue
These Terms and any dispute arising from them or from your purchase are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.
You and we agree that any lawsuit will be brought exclusively in the state or federal courts located in Williamson County, Tennessee, and both of us consent to the personal jurisdiction of those courts.
23. Resolving a problem
Please talk to us first. Most problems are solved with one phone call. Contact us at (615) 771-9595 or info@oliviaevoo.com and give us 30 days to resolve the issue before starting formal proceedings. Nothing in this section prevents either of us from bringing a claim in small claims court.
24. General
If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of the business. These Terms, together with our Privacy Policy and Returns & Refunds policy, are the entire agreement between you and us regarding the Site and your purchases.
